Aletarch Inc respects the intellectual property of others and expects users of Eidren to do the same. This policy explains how to report material on the Service that you believe infringes your copyright, how a user can respond, and what we do about repeat infringement. It forms part of the Terms of Service.
1. Designated agent#
Notices under the Digital Millennium Copyright Act (17 U.S.C. §512) should be sent to our designated agent:
Copyright Agent, Aletarch Inc c/o Corporation Service Company, 251 Little Falls Drive, Wilmington, Delaware 19808, United States Email: support@aletarch.com (subject line "Copyright") Telephone: listed in the Copyright Office's DMCA Designated Agent Directory under registration DMCA-1081824
Email is the fastest route. The postal address is our registered agent's and is suited to formal service rather than correspondence.
2. Sending a notice of claimed infringement#
To be effective under 17 U.S.C. §512(c)(3), your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work you claim has been infringed, or a representative list if the notice covers multiple works.
- Identification of the material you claim is infringing and that you want removed or disabled, with enough information for us to locate it, such as the URL or the Account and workspace in which it appears.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
A notice that knowingly misrepresents that material is infringing may make you liable for damages under 17 U.S.C. §512(f). If you are not sure whether material infringes, consider taking legal advice before sending a notice.
3. What we do with a valid notice#
On receipt of a notice that meets the requirements above, we will remove or disable access to the material promptly, notify the user who posted or generated it, and give that user a copy of the notice. We may ask you for clarification if a notice is incomplete, and we will tell you if we decline to act.
4. Counter-notice#
If material you provided or generated was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the designated agent. Under 17 U.S.C. §512(g)(3) it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which Aletarch may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will forward the counter-notice to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action to restrain the alleged infringement, we may restore the material between 10 and 14 business days after receiving your counter-notice.
5. Repeat infringers#
We terminate the Accounts of users who are the subject of repeated valid notices, and we may terminate an Account after a single notice where the circumstances warrant it. We may also decline to restore material or to accept further content from a user whose Account has been terminated under this policy.
6. Other intellectual property#
This policy addresses copyright. To report trademark or other intellectual property concerns, email support@aletarch.com with the subject "IP notice" and the details of your claim.
